Terms of Service

Please read these Terms of Service ("Terms") carefully before using the AI Usage Tracker iOS application ("Service") operated by AI Usage Tracker ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the AI Usage Tracker application, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

You must be at least 16 years of age to use this Service.

2. Description of Service

AI Usage Tracker is an iOS application that allows you to:

• Connect your accounts with AI providers (Anthropic, OpenAI, Google Gemini, AntiGravity/Cloud Code) using OAuth2 authentication
• View your real-time API usage, token counts, and rate limit status across connected providers
• Track historical usage trends (Premium feature)
• Display a homescreen widget showing current usage (Premium feature)

The Service acts as a secure usage aggregation layer — we fetch your usage data from provider APIs using encrypted OAuth tokens stored on your behalf. We do not access, store, or process the content of your AI conversations.

3. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete registration information
• Keep your login credentials (email and password) confidential and secure
• Notify us immediately of any unauthorized use of your account at [email protected]
• Be responsible for all activity that occurs under your account
• Not share your account with any third party
• Use the Service only for lawful purposes and in accordance with these Terms

You are responsible for maintaining the security of your connected provider OAuth tokens. If you believe a provider connection has been compromised, disconnect it immediately in the app.

4. Premium Purchases

Purchase Terms

• Premium is a one-time lifetime purchase — no subscription, no recurring charges
• All purchases are processed by Apple Inc. via the App Store. Apple's payment terms apply
• Prices may vary by region and are subject to Apple's pricing tiers
• Premium unlocks: homescreen widget, unlimited usage history, multiple accounts per provider, and connection of more than one provider

Refund Policy

Restore Purchases

If you reinstall the app or switch devices, tap "Restore Purchases" in the app to restore your Premium status. Your purchase is tied to your Apple ID.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use the Service to violate any applicable laws or regulations
• Attempt to circumvent rate limits or quotas of AI providers using our Service
• Use the Service to scrape, harvest, or collect data about other users
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Create accounts by automated means or under false pretenses

6. Intellectual Property

The AI Usage Tracker application, including its design, code, features, and branding, is owned by us and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app on your personal Apple devices in accordance with these Terms.

The names and trademarks of AI providers (Anthropic, OpenAI, Google) are the property of their respective owners. Our use of these names is for descriptive purposes only and does not imply endorsement or affiliation.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or completeness of usage data (we display what provider APIs return)
• Continuous, uninterrupted, or error-free operation
• Fitness for any particular purpose

AI provider APIs (Anthropic, OpenAI, Google) may change, be deprecated, or become unavailable. We are not responsible for disruptions caused by changes to third-party provider APIs or policies.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AI Usage Tracker and its operators shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or other intangible losses
• Damages resulting from interruption or cessation of the Service
• Damages resulting from bugs, viruses, or errors in the Service
• Any actions or omissions of third-party AI providers

Our total aggregate liability for any claims relating to the Service shall not exceed the amount you paid for Premium, if any.

9. Termination

You may stop using the Service and delete your account at any time. To delete your account and all associated data: open the app, go to Account → Delete Account. Account deletion is permanent and irreversible.

We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ceases immediately.

10. Third-Party Services

The Service connects to third-party AI provider APIs (Anthropic, OpenAI, Google). Your use of these providers is subject to their own terms of service and privacy policies. We are not a party to your agreements with these providers and are not responsible for their services, policies, or actions.

The App Store purchase flow is governed by Apple's Terms of Service.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany and applicable EU law, without regard to conflict of law provisions. Our infrastructure is hosted in Germany (Hetzner Online GmbH).

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.

12. Changes to Terms

We may revise these Terms from time to time. Material changes will be communicated via an in-app notice or update to this page. The "Last updated" date at the top indicates the most recent revision. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
